1. INTRODUCTION AND ACCEPTANCE
These Terms and Conditions of Use (“Terms”) constitute a legally binding agreement between you (“User,” “Learner,” or “you”) and Fish Vigyan (“Company,” “we,” “us,” or “our”) governing your access to and use of the Fish Vigyan Academy eLearning platform at academy.fishvigyan.com (the “Platform”), including all associated subdomains, mobile applications, and online services (collectively, the “Services”). By accessing, browsing, registering an account, enrolling in courses, or otherwise using any part of the Services, you unconditionally accept and agree to be bound by these Terms in their entirety. If you do not agree to all provisions contained herein, you must immediately discontinue all use of the Services.
The Company reserves the exclusive right to modify, amend, or update these Terms at any time without prior notice, except where prohibited by applicable law. Material changes will be communicated through prominent notice on the Platform or via direct notification where feasible. Your continued use of the Services following such modifications constitutes your affirmative acceptance of the revised Terms.
2. DESCRIPTION OF SERVICES
Fish Vigyan operates the Fish Vigyan Academy as an eLearning platform providing:
- Educational Content: Comprehensive courses, tutorials, videos, quizzes, and resources on aquaculture and fish farming techniques, including topics like biofloc farming, pond management, and ornamental fish farming.
- Learning Management System (LMS): User accounts, course progress tracking, certifications, and interactive features like discussion forums or webinars.
3. INTELLECTUAL PROPERTY RIGHTS
All content, materials, and features available through the Services, including but not limited to text, graphics, logos, images, videos, course materials, quizzes, software, and their selection and arrangement (collectively, “Proprietary Materials”), are the exclusive property of Fish Vigyan, its licensors, or content providers and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial educational purposes only. This license expressly excludes: any resale or commercial use of the Services or Proprietary Materials; the collection and use of course content, descriptions, or certifications; any derivative use of the Services or Proprietary Materials; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.
Unauthorized use of the Proprietary Materials may violate copyright, trademark, and other laws. You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit the Services or any portion thereof without the express written consent of Fish Vigyan.
4. USER CONDUCT AND RESTRICTIONS
As a condition of your use of the Services, you warrant and covenant that you will not utilize the Services for any purpose that is unlawful or prohibited by these Terms. You agree to comply with all applicable local, national, and international laws and regulations, including India’s Information Technology Act, 2000.
Specifically, you agree not to engage in any of the following prohibited activities:
- Uploading, posting, or transmitting any material that infringes upon the intellectual property rights, privacy rights, or publicity rights of any third party.
- Posting content in discussion forums or webinars that contains viruses, Trojan horses, worms, or other harmful code.
- Sharing course access credentials or content with unauthorized users.
- Engaging in conduct that is defamatory, obscene, harassing, or otherwise objectionable.
- Using automated systems (e.g., scrapers, crawlers) to extract or repurpose content, except for standard search engine crawlers respecting noindex/nofollow directives.
The use of extracted content for artificial intelligence model training, commercial dataset compilation, or competitive analysis is strictly prohibited. Fish Vigyan reserves the right to terminate or restrict your access to the Services, without prior notice, for any conduct that it, in its sole discretion, deems to be in violation of these Terms or harmful to other users, the Services, or third-party providers.
5. LMS-SPECIFIC PROVISIONS
5.1 Course Access and Enrollment
- Courses are accessible upon successful enrollment and payment, where applicable. Access may be time-limited based on course type (e.g., subscription-based or one-time purchase).
- You agree to provide accurate and complete registration information and to maintain the security of your account credentials.
- Sharing course access or content with non-enrolled users is prohibited and may result in account suspension.
5.2 Pricing and Payment Terms
- All prices for course subscriptions or purchases are displayed in Indian Rupees (INR) by default but may be shown in other currencies based on your region of access, using real-time exchange rates or localized pricing. Prices are subject to change without prior notice.
- Payment must be made in full at the time of enrollment through designated payment gateways (e.g., Razorpay, PayPal). You authorize Fish Vigyan to charge the specified amount to your chosen payment method in the displayed currency. Invoices for all purchases will be issued by Fish Vigyan.
- All sales are final unless otherwise specified in the refund policy.
5.3 Refund Policy
- Refunds cannot be made after successful course purchase.

5.4 Certifications and Course Completion
- Certifications are issued upon successful completion of course requirements (e.g., quizzes, assignments), as determined by Fish Vigyan.
- Certifications are for personal use only and may not be transferred, sold, or used for commercial purposes without written consent.
5.5 Site and Course Availability
- Fish Vigyan strives to ensure continuous access to the Platform and its courses but does not guarantee uninterrupted availability. The Services or specific courses may be unavailable due to technical issues (e.g., server downtime, maintenance), natural calamities (e.g., floods, earthquakes), or discontinuation of business operations.
- In such cases, Fish Vigyan shall not be liable for any loss or inconvenience caused by the inability to access the Platform or courses. Users will not be entitled to refunds or compensation for periods of unavailability.
5.6 Disclaimers
- Educational Content: All course content, including tutorials, videos, and quizzes, is provided for informational and educational purposes only and does not constitute professional advice. Fish Vigyan is not liable for any actions, outcomes, or losses resulting from the application of course content, including but not limited to aquaculture practices or business decisions.
- Platform Performance: Fish Vigyan does not guarantee that the Platform will be error-free, secure, or continuously available. Users assume all risks associated with using the Services, including technical failures or data loss.
- Third-Party Links: The Platform may include links to external websites or resources (e.g., payment gateways, course references). Fish Vigyan is not responsible for the content, accuracy, or practices of these third-party sites.
- No Warranties: The Services are provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or merchantability.
6. DISPUTE RESOLUTION AND GOVERNING LAW
6.1 Negotiation and Arbitration
Any disputes arising out of or relating to these Terms or your use of the Services shall first be subject to a thirty (30) day good faith negotiation period, initiated via written notice to fishvigyan@gmail.com.
If the dispute remains unresolved, it shall be settled by binding arbitration in Howrah, West Bengal, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted before a sole arbitrator appointed by mutual agreement. The language of the arbitration shall be English.
6.2 Class Action Waiver
You and Fish Vigyan agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
6.3 Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to the arbitration provisions above, the courts in Howrah, West Bengal shall have exclusive jurisdiction over any disputes not resolved through arbitration.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Fish Vigyan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: your access to or use of or inability to access or use the Services; any conduct or content of any third party on the Services; any content obtained from the Services; or unauthorized access, use, or alteration of your transmissions or content.
In no event shall Fish Vigyan’s aggregate liability for all claims relating to the Services exceed the amount you paid to Fish Vigyan, if any, for access to the Services during the twelve (12) month period preceding the claim.
8. GENERAL PROVISIONS
8.1 Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
8.2 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Fish Vigyan’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
8.3 Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by Fish Vigyan on the Services, shall constitute the entire agreement between you and Fish Vigyan concerning the Services.
9. AQUACULTURE-SPECIFIC PROVISIONS
9.1 Educational Content Usage
Users applying Educational Content to operational practices assume full responsibility for verifying compliance with:
- The Biological Diversity Act, 2002.
- Guidelines issued by the National Fisheries Development Board.
- State-level aquaculture regulations.
9.2 Live Organisms Advisory
Information regarding aquatic species in courses does not constitute authorization for possession or cultivation. Users must independently verify:
- Restrictions under the Wildlife Protection Act, 1972.
- Coastal Aquaculture Authority regulations (where applicable).
- Local zoning laws for aquaculture operations.
9.3 Course Content Accuracy
Course materials are designed based on industry standards and Fish Vigyan’s expertise. Performance outcomes may vary due to:

- Environmental conditions (e.g., temperature fluctuations).
- User application of techniques.
